BRIEF SUMMARY

Michael Donnelly (an American citizen) married Indonesian national, Ni Made Jati, in Los Angeles in 1985 and moved to Bali in 1987. There Ni Made Jati established a secret double identity and acquired documents including a false marriage certificate claiming a Balinese wedding ceremony in 1996. These documents were used in 2005 for a divorce accusation which would give Ni Made Jati control of the couple's children and assets. Michael Donnelly, in trying to prove his 1985 marriage, found that the Indonesian courts, the police, and even his own lawyers were conspiring with Ni Made Jati against him. He then felt obliged to flee Indonesia with his children in fear of their lives.

CHRONOLOGY

14th September 1985. Michael Donnelly (United States citizen) marries Ni Made Jati in Los Angeles, California.

December 1985 - the couple celebrate their wedding in Kuta, Bali, with Made's parents, her family and friends before returning to California to start their life together.

May, 1986 - unknown to Michael Donnelly, Ni Made Jati establishes a new identity in Tabanan as a single woman.

18th May 1992 - in Tabanan, Ni Made Jati obtains a certificate confirming her status as unmarried in order to arrange a land certificate.

17th March 1993 - the couple's first son is born in California.

2nd April 1994 - Ni Made Jati acquires a certificate stating she married in Gianyar.

23rd May, 1994 - Michael Donnelly and Ni Made Jati undergo a Bali Hindu marriage ceremony in Sanur, Bali, to "make Ni Made Jati's family happy". This ceremony was later used to invalidate their 1985 California marriage.

1st September, 1994 - while living with Michael Donnelly and her son in Sanur, unknown to Michael Donnelly, Ni Made Jati acquires a single person's identity card in Tabanan, which would be used in 1996 to acquire new marriage documents in Denpasar.

17th September 1994 - the couple's second son is born in Singapore.

June, 1995 - in Sanur, Bali, Ni Made Jati has an affair with an expatriate.

10th October, 1995 - Ni Made Jati reports to the Indonesian authorities that Michael Donnelly is married, based on a certificate issued 14th September 1985 in Los Angeles.

19th October, 1995 Ni Made Jati reports to the Indonesian authorities that she is married and living in Sanur; but gives her place of birth as Tabanan rather than Denpasar.

12th February, 1996 - in Tabanan, Ni Made Jati acquires another certificate stating she was "never married" in Tabanan, in order "to obtain a marriage licence."

10th June, 1996 - Ni Made Jati acquires a document in Tabanan certifying the taking place of a Bali Hindu wedding ceremony, which she uses to acquire a new marriage certificate from Denpasar the same year.

23rd September, 1996 - Ni Made Jati claims the existence of a Bali Hindu marriage in Kuta that was fictional. Later, in court, Ni Made Jati's sister Nyoman Suti and Heru Widiyanto would testify that they witnessed this ceremony in Sanur in 1996. Later still, Ni Made Jati would admit that they were lying. However, with documents from her imaginary Bali Hindu ceremonies, and an explanation to Michael Donnelly that the couple was registering their 1985 California marriage, Ni Made Jati acquires an entirely new marriage from the Kantor Catatan Sipil. Denpasar Timur, Bali.

8th July, 2002 - Michael Donnelly discovers Ni Made Jati's visa application for Austria, which uses her expatriate lover's mother as guarantor.

23rd April, 2005 - Ni Made Jati files for a divorce. In the documentation, Ni Made Jati, without mentioning the 1985 California marriage, claims she and Michael Donnelly were married in a Bali Hindu ceremony at her home in Kuta in 1996, but that, according to a Family Registration Card, Michael Donnelly was not a member of the family. This did not perturb the District Court in Denpasar.

22nd November, 2005 - ignoring Michael Donnelly's witnesses and his California marriage certificate, the Denpasar District Court grants the divorce request. The divorce relates to marriage in 1996, which conveniently makes the two children illegitimate and, therefore, not U.S. citizens and invalidates Michael Donnelly's legal paternity. The ruse also renders all the marriage's pre-1996 assets as Ni Made Jati's.

2nd December 2005 - since Michael Donnelly appears to have no legal paternity, Ni Made Jati tries to take the children; but Michael Donnelly applies to the Court of Appeal and custody returns to its status quo.

18th March, 2006 on reading the judgement of the Denpasar District Court Michael Donnelly finds that the court reporter has reversed and falsified the testimony of his witnesses.

12th April, 2006 - the Appeal Court upholds the District Court's judgement and Michael Donnelly realises his lawyer - from the Austrindo Law Office - never filed a Memo of Appeal and he suspects he was in fact working for Ni Made Jati. His new layers determine that: “Individuals of the court, Polda Bali (police) and Rifan of Austrindo Law Office had collaborated to suppress witnesses, falsify evidence, and deceive him into believing that a true court deliberation and a true police investigation had taken place. In fact, it seemed, the decision and investigation were fraudulent.”

14th May, 2006 - Ni Made Jati is called to Polda Bali (the provincial police)and when confronted by photos and the testimony of 21 other witnesses, she admits she, Nyoman Suti and Heru Widiyanto had lied when they testified in court that a Bali Hindu marriage ceremony had taken place in 1996.

15th August, 2006 - in her "Reply to Accusation of Action Contrary to Law," Ni Made Jati admits that she had married Michael Connelly in 1985 in California, and that the actual Bali Hindu ceremony had occurred in 1994 in Sanur.

12th September, 2006 - Polda Bali complete their fraud investigation against Ni Made Jati and submit it to the prosecutors office (Jaksa) for an indictment; but the Jaksa reject it and return it with a request for more evidence.

11th October, 2006 - Polda Bali add the evidence requested and return the dossier to the Jaksa,; but again the Jaksa reject it and return it with a request for more evidence.

15th November, 2006 - once again Polda Bali add the evidence requested and return the dossier to the Jaksa,; but yet again the Jaksa reject it and return it with a request for more evidence.

19th December, 2006 - once again Polda Bali add the evidence requested and return the dossier to the Jaksa,; but yet again the Jaksa reject it and return it with a request for more evidence.

16th January, 2007 - once again Polda Bali add the evidence requested and return the dossier to the Jaksa,; but yet again the Jaksa reject it and return it with a request for more evidence.

5th February, 2007 - once again Polda Bali add the evidence requested and return the dossier to the Jaksa,; but yet again the Jaksa reject it and return it with a request for more evidence.

March, 2007 - once again Polda Bali add the evidence requested and return the dossier to the Jaksa,; but yet again the Jaksa reject it and return it with a request for more evidence.

April, 2007 - once again Polda Bali add the evidence requested and return the dossier to the Jaksa,; but yet again the Jaksa reject it and return it with a request for more evidence.

22nd April, 2007 - the Supreme Court Rules that the 1985 California marriage is valid in Indonesia; but withholds the decision until January, 2008.

May, 2007 - once again Polda Bali add the evidence requested and return the dossier to the Jaksa,; but yet again the Jaksa reject it and return it with a request for more evidence.

17th May, 2007 - Ni Made Jati, Ida Bagus Wikantara and Heru Widiyanto drive Gary Hewson out of the Kori Restaurant, despite Hewson having a clear written agreement signed by Ni Made Jati stating that he was a 50% partner. Gary Hewson reports this as fraud to the police.

4th June, 2007 - once again Polda Bali add the evidence requested and return the dossier to the Jaksa,; but yet again the Jaksa reject it and return it with a request for more evidence.

July, 2007 - once again Polda Bali add the evidence requested and return the dossier to the Jaksa,; but yet again the Jaksa reject it and return it with a request for more evidence.

1st August, 2007 - while at his parents' house in Los Angeles, California, with his two boys, Michael Donnelly receives a death threat by mail. He returns to Bali alone to discuss this with Ni Made Jati.

August, 2007 - yet again Polda Bali add the evidence requested and return the dossier to the Jaksa,; but once again the Jaksa reject it and return it with a request for more evidence.

5th August, 2007 - the US embassy in Jakarta, advise Michael Donnelly to leave Indonesia.

10th August, 2007 - Ni Made Jati's lawyer, Ida Bagus Wikantara, took thugs to the Kori Restaurant. Michael Donnelly and Gary Hewson jump in the back of a police vehicle to escape.

14th August, 2007 - Michael Donnelly flees Indonesia and starts a new life with his two sons in San Dimas, California.

September, 2007 - Polda now drop the case against Ni Made Jati.

22nd November, 2007 - Polres Tabanan (the local rather than the provincial police) issue an arrest warrant for Ni Made Jati in relation to false documentation in connection with the land under Kori Restaurant. However, Ni Made Jati had already fled Indonesia and had gone to live in Newport Beach, California.

15th January, 2008 - Michael Donnelly receives the Supreme Court decision confirming the supposed 1996 Hindu marriage was not valid.

19th March, 2008 - Ni Made Jati petitions for custody of the children in the Superior Court of California County of Los Angeles Pomona.

May, 2008 - in the Tabanan "False Documents" case, the chief investigator with the local police is abruptly transferred out of Tabanan. The arrest warrant issued for Ni Made Jati is quashed, making it safe for her to return to Indonesia.

4th June, 2008 - Ni Made Jati is ordered to appear in California Superior Court; but her attorney, Julie Duncan, shows up alone and says Ni Made Jati has returned to Bali.

10th November, 2008 - the Indonesian Supreme Court rules that the 1996 marriage documents had been illegally acquired in a manner "contrary to law" and orders their expungement from the records office.

3rd March, 2009 - Julia Duncan, Ni Made Jati's attorney in the case before the Superior Court of California County of Los Angeles Pomona, resigns to 'protect herself'.

17th March, 2009 - the Superior Court of California County of Los Angeles, Pomona, finds that Ni Made Jati abandoned her children.

19th May, 2011 - Michael Donnelly and his two sons travel to Jakarta under the sponsorship of the National Commission for Protection of Children (KNPA) hoping that Ni Made Jati would honour a summons from the KNPA to come to Jakarta and meet her children; but she refuses.

27th May, 2009 - Michael Donnelly enters a petition in Denpasar District Court requesting a 50/50 division of family assets and enforcement of California child support orders. In response Ni Made Jati claims everything in Indonesia belonged solely to her, and that she built up all the couple's businesses entirely on her own. She objects to providing any financial support for the children. In fact, Nu Made Jati used money, which should have been for the children's college education, to build a new dive resort in Gili Air--7 Seas International.
